1. Acceptance of Terms
By accessing and using the Aplus application (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. The Service is operated by Tadeáš Jalovec ("we", "us", or "our").
2. User Accounts
You must create an account to use most features of Aplus. You sign in through a third-party provider (Google), and you are responsible for maintaining the security of the account you use to sign in. You agree to accept responsibility for all activities that occur under your account. Aplus uses Supabase to securely manage authentication.
3. User Content
Aplus allows you to upload or create study materials, including PDF documents, text files, images, and voice recordings. You retain all rights to the content you upload. You represent and warrant that you own or have the necessary rights to the content you upload and that it does not infringe any third party's copyright or other rights — you are solely responsible for the content you provide. Do not upload content that you do not have the right to use, that infringes intellectual property rights, or that contains malicious code. By uploading content, you grant Aplus a limited, non-exclusive license to store and process it solely to provide the app's features (such as generating quizzes and study insights); we store it only to operate these features and may remove any content that violates these Terms. If you believe content on Aplus infringes your copyright, contact us at [email protected] and we will review and remove infringing material where appropriate.
4. AI Features Disclaimer
Aplus utilizes advanced artificial intelligence (OpenAI API) to analyze your study materials and generate quizzes, study notes, insights, and Ako's conversational replies, and uses a third-party voice service (ElevenLabs) to convert those AI-generated replies into spoken audio. While we strive for high quality, AI-generated content may sometimes be inaccurate, incomplete, or misleading. Aplus does not guarantee the 100% accuracy of any AI-generated content. You should independently verify any critical information. Aplus is a study aid, not a replacement for official course materials.
5. Acceptable Use
You agree not to use Aplus for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction.
6. Modifications to Service
Aplus reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice.
7. Subscriptions and Billing
Aplus offers auto-renewing subscriptions (Weekly and Monthly) to access premium features. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription automatically renews unless cancelled at least 24-hours before the end of the current period. Your account will be charged for renewal within 24-hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your App Store or Google Play Account Settings after purchase.
8. Age Requirements
Aplus is intended for users who are at least 13 years old. If you are under 18 (or the age of legal majority where you live), you may only use Aplus with the consent of a parent or legal guardian who agrees to be bound by these Terms of Use.
9. Disclaimer of Warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content — including AI-generated study materials — will be accurate, complete, or reliable. You use the Service at your own risk.
10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Tadeáš Jalovec be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to your use of (or inability to use) the Service, even if advised of the possibility of such damages. To the maximum extent permitted by applicable law, our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us, if any, in the three (3) months preceding the event giving rise to the claim, or (b) USD 50. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless Tadeáš Jalovec from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with the content you upload, your use of the Service, or your violation of these Terms or of any applicable law or third-party right.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict-of-law provisions. The courts of the Czech Republic shall have jurisdiction over any dispute arising out of or relating to these Terms. If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of your country of residence, and nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
